On the one hand, he is obviously voting no, plain and simple. He knows that.

On the other hand, he also says very clearly that for him it certainly was
not a slam-dunk.  I was more interested in his discussion than his nay
vote, actually.

But he cannot get around the fact that he voted no.  Fair is fair.  If you
know your vote is counted as a no, then your vote is a no. Abstaining is
pretending to be on the fence; no way was he on the fence at the end of the
day; he voted against.
