Having read the judgement I cannot envisage any rational and/or legam 
basis for Judge Rader dissenting.  The Agency broke the agreement 
(contract) intentionally and should lose.  In other situations if the 
correct procedure has not been followed then evidence is not admissible 
and acquittal of the accused follows, even when it is clear that they 
are guilty.

Here there was clear and deliberate illegal action (in referring to 
documents it had agreed to rescind) by the Agency and failure to do what 
they had undertaken to do.  I would like to think the managers 
responsible were subject to disciplinary action but I haven't seen any 
herds of pigs flying by recently.
